By-Laws for Developers - from $1,650 inclusive of GST

We offer a range of fixed cost legal services to developers of proposed strata, part strata and community titled properties. These include developer by-laws, strata management statements, community management statements, and registration of new scheme.

Developer Strata By-Laws

By-laws registered with the strata plan are generally more powerful and harder to challenge than those made after registration of the strata plan. 

When a strata plan is registered it must include a set of by-laws. These can be the model by-laws prescribed by the regulations made under the Strata Schemes Management Act 2015 or other by-laws. 

Fixed Cost By Laws can draft a set of specific by-laws that are relevant for the development. These include by-laws for the control and management of the lots and common property, renovations, and grants of exclusive use rights and special privileges.

Strata Management Statements

Land in part of a building may be subdivided by a strata plan, but only if (amongst other things) a strata management statement is registered with the plan.  There are exceptions to this requirement. 

Fixed Cost By Laws can draft a specific strata management statement that is relevant for the development. That includes shared facility and cost schedules, workable dispute resolution clauses, and consistency with by-laws for any affected strata scheme. 

Community Management Statements

Land may be subdivided by a community plan to create a neighbourhood scheme or a community scheme that may be further subdivided into neighbourhood schemes, precinct schemes, and/ or strata schemes but only if (amongst other things) a community, neighbourhood, or precinct management statement is registered with the plan.  There are exceptions to this requirement. 

Fixed Cost By Laws can draft a specific community, neighbourhood, or precinct management statement that is relevant for the development. That includes by-laws, shared facility and cost schedules, workable dispute resolution clauses, and consistency with by-laws for any affected strata scheme or other association.
